About the Author
Gordon Silverstein is Assistant Professor of Political Science at the University of California, Berkeley. A former journalist with a PhD from Harvard University, Massachusetts, Professor Silverstein also has taught at Rice University, Houston, Dartmouth College, Lewis and Clark College, Portland, and the University of Minnesota. Silverstein has written a number of articles and book chapters on American politics, the separation of powers, and judicial power in comparative perspective and is the author of Imbalance of Powers: Constitutional Interpretation and the Making of American Foreign Policy (1996).

When Law Lures

Gordon Silverstein in Law's Allure argues that law has the ability to shape, constrain, and kill politics. Siversteins big contribution is the notion that over the last forty years or so beginning with Brown and the Civil Rights movement, there has been an increased jurification by the allowing complicated matters of public policy like environmental, woman's rights, campaign finance, war powers, and several other cases have been decided through the court system rather than through complicated bargaining, compromising, promising, and negotiation of politics. This jurification can be both a blessing and a curse. In matters like school desegregation it can provide politicians needed cover for implementation of unpopular decisions because they can claim the court forced them to desegregate--saving politics, when a Court strikes down legislation passed by Congress as unconstitutional, it provides a guide as to what the legislative branches can do allowing Congress to act within set frameworks--constraining politics. Killing politics comes in like with big tobacco where courts orders a big settlement, closing any political negotiations that were taking place. Highly recommended along with the Gerald Rosenberg and Thomas Keck for a look at the societal aspects of the court system.
